Well, Mindia already has a version 2.0 patch that reduces the grind and lowers the odds of status effects hitting you. They must have realized their mistake really fast once people got their hands on the game. I think they did a decent job on the battle system considering how limiting single character combat can be, but I'm still confused as to why h-game developers keep making battle systems that belong in the early 80's. If they want to stick with a lone protagonist, they can still do a Shin Megami Tensei-style or Pokemon-style system. Naedoko Dungeon Chronicle is a great example of this working well.
Naedoko effectively still use the older RPG format though. And with the monsters replacing the player classes.
As for why they're using older combat system, probably because that's the one that's freely available (like, really free, no 'but if you're gonna use it for commercial use' license fee) and not many people want to mess around with the system or search for someone who did to get a different combat system (like the rather messy combat in Wrath of King Vasily with Tales-esque type, or the slightly acceptable top-down view of VH similar to Secret of Mana type)
Pokemon is just a variant to the old RPG combat too, it's still turn based, just that instead of Attack/Magic/Defend/Items you only have Magic (4 of them) and Items. (The Super Effective/Ineffective message replace elemental weakness like the old Undead taking damage from Heal)
I think what you're asking for is more balanced/thought out skills options, rather than MASHFINGERTILWIN/INSTANTWINBUTTON/WHYWOULDYOUEVERDEFEND/DRUGSFORMOARWINBUTTONUSAGE type.
On that note though, balancing a game where everyone get 1 slap a turn (with speed only determining who get to slap first) is a lot easier than, say, the open field tabletop like Warhammer style games or any beat-em-up type.
