Why not ask azure where tentacle sumo went?

Azure promised that, and announced as such, but did not deliver. He stole the money that was to be used for that from me and has not delivered on his promise to make that part of the game. That was to be planned as a free addition to the game after the game sold 50 copies.

As to the deal that was made, we had initially agreed at the point that the game would be made on simple terms. Azure failed to deliver on those terms.

Why shouldnt I get my lawyers involved? I pay them for a reason, may as well put them to use. Just because it will be a very one sided affair, it will teach someone a lesson not to screw people over when they are in no position to deal with the consequences.

This game is not azure's in any way shape or form. As I stated before, he brokered a deal with me so that he could sell the game. That deal was broken by him and as a result he no longer has any right to sell the game. At some point after this is all resolved I may do something with this game, but for now I am shutting it down.

I already asked toxic to lock this thread. I suppose azure can have some say in this matter to defend himself and his actions, and I know he is currently unavailable to do so.

I think your rapidly diminishing reputation is evidence enough of what this community thinks of your attitude and your side of this story. Why don't you do yourself a favor and quit embarrassing yourself by pretending you're in the right here? Azure made your stupid game to your exact specifications, you're gonna need a whole lot of written proof and contract signatures before you can prove a damn thing in the court of law. Innocence until proven guilty, and as far as I can see, Azure is guilty of nothing - except, perhaps, of the crime of agreeing to work with someone as self-centered and shallow as you.

Greed really has really just ruled here. Long time lurker here on ULMF, rarely do I come out and say/post anything. However, commissioner really has no rights to anything released. Unless you put in at least 50% of the work, which from what I've read isn't the case. Then you have no claim to it. Azure has invested time into this. Time you cant get back. Honestly I'm suprised at this test of character that he hasn't sued you. Keep at it Azure I think your doing great. As far as this greedy personage, get off your high horse, and let it drop. Always trying to make a quick dollar on a sense of entitlement is a quick lesson to embarassment.

It seems that for the most part freeko's been exploiting technicalities to earn from azurezero's work and worse than that, is the one who's doing the suing right now.....from my understanding of the situation anyways.

I am actually suprised people are not asking me for this game. azure did a pretty good job of defrauding me throughout this process and of course is winning this insignificant battle of public favor over irrelevant issues.

The simple facts are that azure lied to me throughout the process. Can azure actually name a game that he has made that was commissioned for 800 gbp by anyone? Right from the start I told azure that I had a budget of X dollars, and I want you to make a game FOR ME. My budget roughly translated to 600 gbp, and azure accepted because he is greedy and needed the money to pay his rent since none of his other games were selling (which he constantly whined about on skype). So what I got was a rushed and incomplete game that was barely half of what I had originally wanted from the whole process.

That azure tried to screw me and sell the game on dlsite was forseen by me, and his reasons for not including dlsite sales in the mix was that he was unable to determine what part of his sales from dlsite were from this game compared to his other games, which is of course another lie. Crystal Factory gives a detailed breakdown by title of sales amounts, so simple math would tell how much should have been split. azure did agree to give me a lower percentage from dlsite sales at one point, but much like the rest of our agreement I do not have any good faith basis to believe that he will keep that part of it either.

So now all you insignificants have another reason to negrep me. Dont bother with the truth since that is a matter that will not be resolved here. azure was given a choice to buy out my interests in the game, so pending that choice he can avoid further legal action. Until then he is no longer working on this project as I already have sought out other artists to finish this game for me instead of azure.

I thought your lawyers told you to shut the hell up? You should probably listen to them. They seem a lot smarter than you with your baseless accusation throwing, and I just love your ability to blot out any relevant points of interest that would be a negative towards your side of the battle. Like the fact that someone is considered innocent in the court of law until proven otherwise. I've seen no shred of evidence that Azure has done a single one of the deplorable things you insist he's done, and he's certainly not being an elitest holier-than-thou douche about it like you.

Public opinion matters, and you're a damned fool to say otherwise - or more likely, as I suspect, you're just dismissing any realistic viewpoints that don't make you feel like a big, strong man delivering justice upon these lowly neophyte H-makers.

Why would he need permission to sell it on dlsite if the original terms were that he retains ownership to the game and no mention of dlsite selling being disallowed? It wasn't "any profits split between us", it was half paypal sales. He agreed to split dlsite sales at some point? If for the sake of argument that's true, That doesn't make previous dlsite sellings prior to that illegal.

Half incomplete? That's strange, according to him he was meeting your agreement which you ended up constantly raising. Even if he didn't meet the agreement he had no obligation to do so with you constantly mending it. He only needed to meet what you had originally asked for at the start.

.......Alright, so after reading what I just wrote, I concede that I don't have(or know of) proof that what Azurezo said is true, on that same note though. You don't have(or haven't shown) any proof showing what you said to be true either. And since you are the one with the suing and claims and raising a case. Naturally the burden of proof would lie on you. Which makes you the one who has to either show something or withdraw your claims.

While it's a safe-ish rule of thumb that he who alleges must prove, freeko has to show his evidence to the court, not to some internet forum.

Just so, while "public opinion" may "matter" in some respects, the opinion of this forum will not determine who wins the case.

My interest, though, lies less in seeing who ultimately wins, and more in seeing if freeko is going to go to court IRL, using his real name, and allege that he's been shafted over an H-game.

While it's a safe-ish rule of thumb that he who alleges must prove, freeko has to show his evidence to the court, not to some internet forum.

And also how quick was everyone on taking a side. As for me? I can't.
I've helped both of them with their own projects and talked with them. I have my reasons to not be able to sway towards one side or the other. (No, don't ask for proof because I don't have that either)

What strikes me as funny, now, is that I know Azure has been working on a platformer (and of course, LustFire is doing the art) but he hasn't made a thread for it.
