Although we both pointed the "why not him" finger around, we want to keep this as isolated as possible. I would hate to be the guy who started pointing all the damn lawyers at Patreon and other artists/creators. In the end we have no choice but to move forward and roll with the punches. It sucks but in the end we will become better for it. Also guys we were avg like 7-8 new patrons/day, since yesterday we have lost 40+ patrons it sucks hard lol.
My advice to you is basically for whatever you make next, cover ALL your bases legally, not only by making the content original, but making sure it doesn't cause any problems with credit card processors, with the legality of the current laws or where they may be headed, etc.

You've got a lot of talent artistically and you guys, as far as I know, were putting out content consistently, so you should be able to succeed with whatever you decide to make next, for sure. :)

(Examples like this though are why I'm so crazy about legal stuff, what happened to Sunset, as shitty as it is, is a prime example of "getting nailed legally can happen to anyone, even if 99% of other creators escape those same problems").

Sunset, you have to expect patrons to start abandoning ship don't you? The project isn't where you want it to be, why should anyone continue to pay for a product you can no longer produce? Or produce without the same level of efficiency...

You'll get em' back as the tides turn... I hope.

Hey SmokeShank , wanted to say that I can really feel your and SR7s pain to have so much amount of your work go to the bin, just because a company doesnt understand the promotion you are doing for them and are afraid from drawn porn.

I was really looking forward to your game and it saddens me such a high quality hentai was stopped. But even if you lost 40 patrons, dont get depressed about it, I'm sure once you start hard working the same way you did with Injustice you will gather more new and loyal fans to your work.

I made an example comic expressly for the evaluation of the processors, and it was my intention for it to depict very simply a rape. The processors reply was along the lines of: "Since she does not say or imply that she is saying "no", it is our judgment that this content would be allowable."

So it shows that how you frame it matters. I think this concept were it not shut down by the infringement of an invisible thing (which I still say lacks standing, but what do I know right?). This would have had issues with being sold on any level since I doubt the processors would allow the subject material.

Thank you HentaiWriter we seem to be alright Patreon somewhat acted as a sheild. And Sunset has been in the game for 10 years, that being said he is big on not violating certain TOS things like getting paid lol. We understood the risks associated and were hoping to at the very least get the complete game out before the hammer of DMCA came down. Not the case of course.

We are still ok! Thanks to the shit Canadian dollar we can hopefully operate fully through this shit storm and get all that we need on our back end. But if not we are prepaired to weather the storm. We are investing heavily in the western porn game market.

This falls on whatever handshake deal Patreon has with stripe. Also I do know of one Adult payment processor who does Paypal transactions also. Although no network or service has tried to acquire them for services (epoch).

I get so much more pissed every year that companies have these knee jerk reactions if god forbid a penis ever shows up in something they have the rights too. I mean it sucks to live in a "Free" country where a woman can go full frontal and have her pictures plastered all over Mr. Skin and pornhub and the only reaction we get is, "It's going to happen since celebrities accept that they will have zero privacy when they go into the business." But yet if you dare to put anything but fade to black in a video game you get slammed with an AO rating and if you have parody material, chances are you get a DMCA takedown along with it. I look at it as everyone knows that Rule 34 is a very real thing and if you want to put sex in a video game it shouldn't be treated any differently than half the movies and TV shows that feature gratuitous nudity.

It's like having sex without a condom, if you don't have the conversation about what to do if you breed life then really you should wrap it up. Same goes with Rule34, Sunset said to me not even a day earlier "The likelihood has to be super low". I had seen signs when doing keyword searches on Google. I wish they gave us like a 3 month window lol. We are going long (meaning we want to be here for a very long time) on the western porn game market and we hope our patrons follow.

Maybe if her name was Catgirl or Ratgirl. But if we want to remain operational for a long time we just have to follow the stupid rules. Sucks I know.

At least I know that if I ever make a game, I probably wont ever get the DMCA takedown since I cant draw for crap. Heck I cant even code at this point. But if I ever do make the game I want I really hope they dont come after me, especially since I want to make a Harry Potter game.

Eh, that does suck, but when you switch over to your new project, you'll get 'em back. It is to be expected, considering those pledges were brought in with Injustice, which is now gone. Still, I've found most people in this community to be quite supportive, especially when the game looks good. Your artist is great, so I've no doubt your next project will be worthy of support.

@HentaiWriter: You mentioned your paranoia with legal issues, but your fear was related to the "obscenity" laws. There is a FAR lower chance of a prosecutor taking an interest in your game development than a company like WB issuing a DMCA. First, the DMCA requires practically no effort on their part, and is way easier to prove than obscenity. An obscenity case that is not related to child pornography would be an uphill battle, and prosecutors generally only take cases where there is a good likelihood they will win. Still, it was your call to make, and I respect the decision--just don't think it applies here.

Check my earlier posts in the thread; it has nothing to do with money.

@Yummy; I realize it is a far lower chance regarding obscenity, but my point is that the chance EXISTS, even if it is a 1 in a million chance, it isn't worth it to me to risk it and lose a year or two worth of work for when it could be avoided from the get go with small changes.

Due to the fact that Injustice had well over 1000hrs invested we want to handle the situation carefully. So planning and execution is of the utmost importance with Injustice and where it will end up. We don't plan of not releasing the game ever that would just be a poor decision. We have to look at development timelines of other projects and slot Injustice in where we feel we can devote the most resources. Anyways we are beginning the planning process next month.

We always wanted to transition to complete OC. The platforms and distribution are all more accessible. I mean we can explore many more opportunities now. We were hoping to slowly transition to this beginning in May, with a slow transition over the course of 10 months. Sunset and myself both agree it's generally not what happens, but how you handle what happens that people remember.

No we never implicitly stated that we were directly profiting off of the property. That statement is purely connecting the dots, legally you can't do that. The problem lies in that we are on Patreon's servers and platform therefore they can say to anyone anytime "We don't like what you do, so delete it or get banned".

If you do a quick google search the latest build was always leaked. Usually within the hour of our release on Patreon. One time I swear it was like 5 mins after I hit submit on Patreon. Our growth on Patreon was unexpected, now we want to mimic the distribution much like Fenoxo or other devs on here. Early access and access to direct communication will be the main draw with our Patreon going forward. Sunset also wants to have all mediums intertwined and connected. So comics that follow what happens in the game, or expands on a character, situation. Lastley Injustice was always slated for a full public release, just during development we decided we wanted to share alpha access. We had much more than Injustice going on.

Im really confused, Sunset was on here 2 days ago and everything was fine and I checked his patreon and there is no mention of him getting a notice to stop development. Still has thousands of dollars in potential pledges and usually when development stops they go through and dump the patreons so they dont get charged.

Edit: Just saw his last post was from October, it just looked like it was from a couple days ago.
I wont believe it until I see a post on here or on his Patreon specifically saying that he has to stop development. His Patreon still has over 600 backers so it's pretty safe to assume that he has not received a notice.
People say he's received a notice but I'm not seeing alot of proof.

Not sure where all this comes from, considering the posts about the DMCA were up on the Sunsetrider7 patreon, clear as day.

Not sure about that "His last post was from october" thing either.
Is there a second SSR7 patreon that you're all looking at?

As for the patreon itself, I did cancel my pledge. Shame that this happened right after i signed up, but I was pretty much just there for Injustice.
When you start flashing stuff for your next game, I'll probably be back.

The post are under patreon only probable why your not seeing them. On patreon they've been talking about building their own website, hopefully their able to do it.

Why not continue Injustice, just on Sunset's tumblr/hentaifoundry page instead? Meanwhile keep the Patreon around with non-DC artwork, but add that the patreon also helps support Sunset's public sites? If you don't host the game on patreon there shouldn't be any violations, and the Patreon was always about supporting Sunset as an artist, and not a specific project.

A very valid question. First I want to state that Patreon requested all content not owned by us 100% be removed (not just WB properties). In this situation we cannot have a knee jerk reaction and hope for the best, we need a carefully drawn out plan. I have said in several places that we were in a very unique position. We had already started planning months ago to move away from non owned properties. Also since Injustice was heading into its last months of development (internally March slated release) we had been in the planning stages of a second project (non OC) for development (after Injustice). So once the DMCA hammer dropped we had a really good idea of what we wanted to do and where to go. What we had not planned for is "what becomes of Injustice if it wasn't complete". So this takes time and care to execute and we need a lot of information before we continue with Injustice. Therefore we move forward and take the plans of the second project (make it OC) and make this an opportunity to jump to where we wanted to be in the beginning of 2017. As a fan it comes as a shock I know, we have over 1000+hrs into Injustice so far. So we want to make sure we finish it, and distribute it so that we lower our risk as much as possible. I just want to conclude that going OC opens a million more doors for us, not only creatively but on the business side. This ultimately effects the end user by having access to more games, that will have more resources and more quality.
