You're violating copyright in many countries regardless as to how much money you make...these kinds of games are considered parodies, so they aren't susceptible to copyright infringement. Also, as long as you don't make any money off the project for distribution, (like Project X) it isn't copyright infringement.
And which countries are those? Besides that, copyright isn't some universal force where if one country makes something illegal, it's illegal across the globe. It's dependent on her country of residence, the country the server for her site is based in, and IF the copyright holder wants to waste money taking down a FREE GAME with copyrighted characters (and that's even if it's illegal in her country/hosts country). Then why do you think the John Doe suits against P2P users in the US happened? None of those people made money, yet all were sued, lost in court, had to pay enormous fines, and had to delete the offending files.And even then, unless I'm mistaken, copyright only applies when money is made, really.
